TERMS AND CONDITIONS
1. By entering this promotion, you accept these Terms and Conditions.
Promotional Period
2. The promotion commences at 9:00am on Monday 01/02/2010 and concludes at 11:59pm on Friday 16/04/2010. This period is referred to as “the promotional period”. Entries received by the Promoter outside the promotional period will be ineligible for the prize draw. The prize draw will take place on 19/04/2010.
Prize summary
3. The grand prize winner will receive an invitation to experience, along with 3 of his or her mates, a New Zealand Under 20 rugby training session.
4. Consolation prize winners will receive official OXY NZRU Under 20 squad gear or OXY product
5. Further details regarding the prizes in this promotion are set out below.
Eligibility
6. Entry is only open to New Zealand residents. Employees (and their immediate families) of the Promoter, the New Zealand Rugby Union (NZRU) and entities associated with this promotion are ineligible to enter.
7. The grand prize winner (and each of the 3 mates chosen by the winner) must be between the ages of 13 and 20 (both inclusive) at the time of the training session in order to be eligible to receive the grand prize. Additional eligibility criteria may be imposed by the NZRU and/or New Zealand Under 20 team management and/or coaching staff. If the grand prize winner is ineligible, the grand prize may, in the Promoter’s sole discretion, be re-drawn.
8.. If the grand prize winner or any of his 3 chosen mates are under 18 years old at the time of the training session, the group must be accompanied by 1 parent or legal guardian (parent/legal guardian is in addition to the 3 chosen mates).
9. The Promoter reserves the right, at any time and at its sole discretion, to verify the validity and eligibility of entries, entrants and prize winners (including an entrant’s identity, age, place of residence and proof of purchase of an OXY product), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or is otherwise ineligible for a prize or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10. Incomplete or indecipherable entries may be deemed invalid at the Promoter’s sole discretion. If there is a dispute as to the identity or age of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity and/or age of the entrant.
Prize draw
13. All prizewinners will be selected by random draw conducted at EBOS Healthcare, 243 - 249 Bush Road, Albany, Auckland, on 19/04/2010 and announced via www.oxy.co.nz by 20/04/2010 (or shortly thereafter).
14. The grand prize winner will be notified by phone and mail and his/her name and city/town of residence will appear at www.oxy.co.nz. All consolation prizes will be sent via registered mail. Tickets and/or vouchers for the grand prize will also be sent via registered mail. The Promoter is not responsible or liable if all or any part of any prize is lost, stolen or damaged in transit. All prize notifications will be made using the name and address details provided on the entry form. By submitting an entry form, the entrant consents to the publication of his or her details in the manner set out above.
15. If, for any reason, the promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of the promotion or which render any prize unavailable in whole or in part, the Promoter reserves the right in its sole discretion to cancel, modify, terminate or suspend the promotion (in whole or in part).
Prize & Notification Details:
16. Acceptance of any prize constitutes consent on the prize winner’s part to allow the use of the prize winner’s name, image, voice and/or likeness by the Promoter (and/or by NZRU and OXY’s manufacturer) for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.
17. Prize winners are advised that tax implications may arise from the prize and independent financial and taxation advice should be sought prior to their acceptance of the prize. The Promoter has no responsibility or liability whatsoever for any such implications.
18. In the event that for any reason whatsoever a prize winner does not take an element of the prize at the time (and in the manner) stipulated by the Promoter, then that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu of that element of the prize.
19. All entrants agree to provide the Promoter or the Promoter’s authorised agent with identification and/or proof of age for themselves as well as for their 3 chosen mates, if drawn as the grand prize winner. In accepting a prize, the prize winner, their 3 chosen mates and any accompanying parent or guardian each agrees to the release set out below. The form of identification and/or proof of age as well as authorisation and release are at the discretion of the Promoter. Failure to provide such proof, authorisation or release will immediately invalidate the prize winner’s entitlement to the prize.
20. If any prize is unclaimed or if the prize winner cannot be contacted in the manner set out above by 30/04/10, it will be re-drawn. This process will be repeated until each prize winner is contacted and the prize is claimed. The prize remains the property of the Promoter until it is collected by the selected prize winner.
21. The Promoter accepts no responsibility for any variation in the value of a prize.
22. No prize is transferable, exchangeable or refundable. Nor is any prize redeemable for cash or kind and each prize must be taken as offered. In the event any prize is not available (in whole or in part), the Promoter may substitute a prize of equal or greater value (as determined by the Promoter).
The Grand Prize – Under 20 training session
24. The Grand Prize comprises:
* Entitlement for the winning individual and 3 mates to experience a training session with the New Zealand Under 20 rugby team
* Return economy airfares1 for the winning individual, 3 mates and, if anyone in the group is under 18, one parent or legal guardian, from the nearest city to the address of the winner (set out on his/her entry form) which is serviced by a nationwide airline to the nearest city to the training session which is also serviced by a nationwide airline (in each case as determined by the Promoter).
* Car transfers (by taxi or alternative transportation nominated by the Promoter) from the airport to the training session or hotel3.
* Car transfers from the training session to the hotel or from the hotel to the training session.
* Car transfers to the airport from the training session or hotel4.
* 1 night’s accommodation, including breakfast, for the winning individual, 3 mates and (if required) 1 parent or legal guardian accompanying the group.
* 1 set of Official OXY NZRU Under 20 Squad Kit (jersey, shorts and socks) for the winning individual and 3 mates.
25. The grand prize pool is valued at up to approximately $8,350

26. Prizes are provided by third parties and are subject to any applicable terms of use issued by, or requirements of, those third party suppliers. In particular, the extent to which the prize winner, any of his/her chosen mates and/or any accompanying parent or guardian may participate in the training session will be determined by the NZRU and/or New Zealand Under 20 team management/coaching staff (who may also require any such participant to provide further information and/or declarations). The Promoter has no responsibility or liability for any such terms, requirements or determination.
27. The prize winner, their 3 mates and any accompanying parent or guardian are responsible for all costs and expenses not specified in these Terms and Conditions as forming part of the Grand Prize, including but not limited to, travel and other insurance, additional expenses incurred during the training session, spending on items of a personal nature (including but not limited to in-room charges), taxes and all other ancillary costs.
28. Prize travel is subject to the carriers’ conditions of carriage. Tickets will not be exchanged for another destination. All components of the grand prize must be taken together. The grand prize winner, his/her 3 mates and any accompanying parent or guardian cannot upgrade any prize travel or prize accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any prize flights or with any prize accommodation. The grand prize winner, his/her 3 mates and any accompanying parent or guardianmust depart from the same airport, travel together on the same flights on all sectors and stay at the nominated hotel in shared rooms. Prize travel may not be changed by the grand prize winner, his/her 3 mates or any accompanying parent or guardianunder any circumstances. If the grand prize winner, his/her 3 mates and any accompanying parent or guardiancannot travel in accordance with these Terms and Conditions and on the flights nominated by the Promoter, the prize will be forfeited. If for any reason the grand prize winner does not take an element of the prize during the stated period, and on the conditions stipulated by the Promoter or any third parties, then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice.
29. The grand prize winner, his/her 3 mates and any accompanying parent or guardian are required to organise their own transfers from home to the airport nominated by the Promoter.
30. If the grand prize winner or any of his/her 3 mates or any accompanying parent or guardian resides in the area of the NZRU training session such that the Promoter considers that air travel is not required, that person will be required to organise their own transport from home to and from the training session. However, the accommodation part of the grand prize, together with car transfers to and from the relevant hotel, will be provided (subject to the remainder of these Terms and Conditions).
Consolation Prizes – gear and product
31. There are a total of 506 consolation prizes to be awarded. Consolation prizes comprise:
* 6 x Official OXY NZRU Under 20 Squad Kit (jersey, shorts and socks)
* 500 x OXY Zit Blitz Gel
32. The total prize pool is valued at approximately NZ$16,545
Release
33. By entering the promotion and by accepting a prize, each entrant and prize recipient acknowledges and accepts that they do so entirely at their own risk. Communicating over the internet involves risk or loss or damage. The Promoter does not control the website www.oxy.co.nz and accepts no responsibility or liability whatsoever for its content, accessibility or for any loss or damage caused by accessing or attempting to access that website. Intense physical activity (such as involved in the training session attended as part of the grand prize) involves risk of injury or death. Each participant must satisfy themselves that they are in an appropriate physical condition before accepting any invitation to participate in any element of the training session.
34. To the fullest extent permitted by law, the Promoter and its associated companies and entities, the NZRU, OXY’s manufacturer, and all of their respective personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the promotion or prizes, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter and their associated companies and agencies and any of their personnel; (iii) any liability for personal injury or death.
Limitation of Liability
35. No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine are incomplete or late or are in any way fraudulent will be declared void.
36. The Promoter makes no representation or warranties as to the quality/suitability/merchantability of any of the goods/services offered as the prize. If the Promoter is liable for any claim by a prize winner, including a claim arising from the Promoter’s negligence, the Promoter’s liability for any such claim will not exceed the value of the prize won as set out in these Terms and Conditions.
37. The Promoter is not liable for the cancellation or modification of all or any part of any prize, for any reason. The Promoter reserves the right to change any prize at any time if that prize becomes unavailable.
Privacy
38. By entering the promotion, the entrant understands and agrees that the Promoter (and OXY’s manufacturer) may collect, hold, use and disclose to third parties the entrant’s personal information to assist in conducting the promotion (including awarding and/or booking prizes) and/or for promotional, marketing, publicity, research and profiling purposes, including for the purposes of sending electronic messages or telephoning the entrant. Entrants in the promotion acknowledge and agree that the Promoter may disclose the entrant’s personal information to the Promoter’s related entities and to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to New Zealand regulatory authorities. Entrants can access the personal information the Promoter holds about them in order to correct that information, and/or notify the Promoter that they do not wish to receive further promotional material by writing to the Promoter at EBOS Healthcare, 243 - 249 Bush Road, Albany, Auckland
39. All entries become the property of the Promoter.
